  1. Introduction

TFVCFashion Lda, corporate entity no. 516212907, with registered office at Rua António Gedeão, 81, Casa 17, is the legitimate owner of the official TFVCFASHION.COM website, whose domain can be found at http://www.tfvcfashion.com.

  1. Purpose

These Terms & Conditions exclusively govern the purchase and sale carried out in the TFVCFashion online store between the “Final Consumer” as buyer and TFVCFashion as seller, and apply to all visitors of the website www.tfvcfashion.com, as well as to any commercial transaction carried out through this online virtual store.

Browsing the website, as well as purchasing any product on http://www.tfvcfashion.com, implies acceptance of these general conditions of use and purchase.

A “Final Consumer” is considered any person who acts/purchases for purely personal purposes, outside their business or profession, and therefore without any intention of reselling the items purchased from the TFVCFashion online store.

TFVCFashion reserves the right to amend these conditions of use and purchase without prior notice, as well as to modify at any time the information and commercial offer presented regarding products, prices, promotions, commercial conditions and services, and any such change shall always be published on the website www.tfvcfashion.com. Any new rules and/or amendments to the Terms & Conditions shall become binding on all users as soon as they are made available on the website www.tfvcfashion.com.

  1. Placing an Online Order

To place an order on www.tfvcfashion.com, the “Final Consumer” must follow the instructions provided. After selecting the item(s), click on “Add to Cart”.

Upon completion of the purchase, the “Final Consumer” will receive an email confirming receipt of the order and its details. We suggest that you print or download this copy for future reference. If the details are not correct, you may immediately request their amendment or even the cancellation of the purchase made.

The purchase shall be completed when the confirmation appears on the screen.

The “Final Consumer” may consult the details of their purchase(s) in their account in our online store, should they decide to register as a TFVCFashion Customer. These details are stored confidentially in our store, in accordance with our Privacy Policy.

In the event of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, TFVCFashion reserves the right not to accept your order, or to cancel it in whole or in part, even after its automatic confirmation.

  1. Shipping / Order Cancellation

TFVCFashion only processes an order placed by a customer after confirmation of the respective payment, therefore the Seller cannot guarantee the availability of the items until the beginning of such processing.

The item(s) will be shipped within a period of two (2) business days.

Naturally, the estimated shipping time may vary depending on the destination of your order. TFVCFashion shall not be responsible for failure to perform, or delay in performing, any shipping obligation caused by a force majeure event, that is, an event, act or omission beyond its reasonable control.

TFVCFashion only ships orders on business days. Therefore, weekends and public holidays are not included in the estimated delivery times. Any delay in the shipment of items, compared to the estimated dates presented, shall not entitle the customer to compensation.

A delivery shall be deemed completed, or a product shall be deemed delivered, upon signature of the delivery receipt at the agreed address.

You may request changes to or cancel your order by email (info@tfvcfashion.com), at any time, up until payment is made.

If you wish to make a purchase and the country/location to which you want the shipment sent is not included in our list of shipping destinations, please send us an email to “info@tfvcfashion.com” or contact us via chat and indicate the item(s) you wish to purchase, and we will return information on the associated shipping costs.

  1. Product Availability and Refusal of Orders

TFVCFashion may choose not to validate an order that does not have sufficient guarantee of proper payment, when the order is incomplete or incorrect, or when the ordered products are no longer available. In any of the cases referred to, TFVCFashion shall inform the “Final Consumer” by email that the sales contract has not been concluded and that TFVCFashion has not proceeded with the sale, specifying the reasons for this.

If the products ordered on www.tfvcfashion.com are no longer available at the time of your latest access to the website, despite the order having been confirmed, or when TFVCFashion receives your request, the “Seller” shall immediately inform the “Final Consumer” of their unavailability, never exceeding the period of 30 days after receipt of the order.

If an order has been placed, and the respective payment made, for products that have meanwhile become unavailable, TFVCFashion shall refund the money paid for the unavailable items.

In the event of an out-of-stock ordered item, you may request a reservation by email to info@tfvcfashion.com. The user shall be informed, within a maximum period of 10 business days, of the replenishment of stock.

TFVCFashion reserves the right to refuse any order, regardless of the reason, and shall be exempt from liability for any damages or costs, as well as reserves the right to cancel any purchase even if it has already been accepted or confirmed by TFVCFashion, namely in the following situations:

The information contained in the invoice is incorrect or unverifiable;
The order is flagged by the website Security Systems as an incorrect, irregular, or potentially fraudulent order;
Payment for the order has not been received within 48 hours following acceptance of your order;
It is not possible to deliver the order to the address provided by the “Final Consumer”;
If it considers that the “Final Consumer” did not have the legal capacity to perform such act;
If it is found that there was an error in the presentation of the price of the product(s);
If it is presumed that the order comes from a reseller.

  1. Payment Conditions and Prices

Orders for item(s) must be paid by bank transfer, Multibanco, VISA or MBWAY.

The prices displayed on this website include VAT at the applicable rate and are valid at the moment the purchase was made. In the event of exchanging the product for another, the value of the final product shall apply. Prices and specifications are subject to change without prior notice.

The prices of the products displayed on the website www.tfvcfashion.com include Value Added Tax (VAT).

The total price specified in the final transaction menu includes taxes and shipping costs.

All prices are shown in Euros and any change in the country of delivery of the order may affect the prices, due to shipping costs.

After placing your order, you will receive an invoice/receipt by post, together with the ordered item(s), at the address indicated during the purchase process.

  1. Security of the TFVCFashion Online Store and All Transactions

The TFVCFashion online store uses the latest and most robust security technologies available for encryption platforms. All payment information you provide will be encrypted from the initial moment of your transaction until the moment the order is processed, and will not be stored on any public server.

Although we use highly advanced encryption software, any payment transmitted via the Internet, or by email, involves certain risks, namely when the “Final Consumer” does not take the proper precautions and does not assume the necessary responsible conduct.

TFVCFashion shall not be held liable for any damage suffered resulting from the use of electronic means of communication, namely damage arising from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties, or by computer programs used for communications or virus transmissions.

  1. Retention of Title of Commercialised Products / Exchange of Items

TFVCFashion retains ownership of the company’s products until it has received full payment for all such products.

Items purchased online may be exchanged/returned at the TFVCFashion store within 14 consecutive days after receipt of the item at the customer’s address, provided that:

The item is in the same original condition or characteristics as when it was sent to the customer;
The corresponding label or security seal has not been removed, or the labels have not been altered from their original condition or damaged;
The item shows no signs of having been washed and/or used;
If there has been an error in the pricing;
If it has not been possible to deliver to the address indicated.

  1. Quality and Warranty

The products offered for sale on www.tfvcfashion.com may not correspond exactly to the actual item in terms of the image displayed and colours, especially due to the internet browser and monitor used.

The “Final Consumer” has the right to return delivered items that present defects or other non-conformities in relation to what was ordered. The return may be made within a period of fifteen (15) days after receipt of the order at the customer’s address.

In the case of a justified return, the price and shipping costs shall be refunded.

  1. Liability

TFVCFashion shall only be liable for damages suffered by the “Final Consumer” where such damages result from breaches attributable to TFVCFashion’s contractual obligations towards the “Final Consumer”, or where liability results from the applicable legal provisions.

If the “Final Consumer” has suffered damages related to the activity of the website, TFVCFashion’s liability shall be limited to: damage to TFVCFashion products, and reasonable and proven costs incurred by the “Final Consumer” as a result of TFVCFashion’s breach of these Terms & Conditions.

TFVCFashion shall not be liable for damages suffered by third parties resulting from the use of any of our products. TFVCFashion shall not be liable for damages suffered by the “Final Consumer” as a consequence of improper use of our products.

TFVCFashion shall not be liable for damages resulting from incorrect information on the website.

All products marketed by TFVCFashion comply with Portuguese and European Union legislation.

TFVCFashion disclaims any liability in the event of breach of the legislation of the country where the order is delivered. It is the Customer’s responsibility to verify with the local authorities the conditions of import or use of the products they intend to order.

  1. Intellectual and Industrial Property

All texts, comments, works, illustrations, creations and images reproduced or represented on the website www.tfvcfashion.com are strictly reserved under copyright law as well as intellectual property rights, worldwide.

Accordingly, and under the terms of the Intellectual Property Code, the use of information is only authorised for private purposes, subject to provisions to the contrary, including more restrictive provisions contained in the said code.

Any reproduction or representation, in whole or in part, of the website www.tfvcfashion.com, or of any of the elements contained therein, is strictly prohibited.

The company names, trademarks and distinctive signs reproduced on the website www.tfvcfashion.com are protected under the applicable legal provisions relating to industrial property. The reproduction or representation of all or part of any such distinctive signs is strictly prohibited and must be subject to prior written authorisation from the holder of the TFVCFashion trademark.

  1. Applicable Law

These Terms & Conditions and all disputes arising therefrom or related to these general conditions, including their validity, the use of the website tfvcfashion.com or any purchase made therein, shall be governed by Portuguese Law.

In the event of a dispute regarding the interpretation or execution of these General Terms and Conditions of Sale, TFVCFashion and the “Final Consumer” undertake to use their best efforts to obtain an amicable solution that is fair and appropriate, within a maximum period of 60 (sixty) days from receipt of the communication addressed for that purpose by either of the parties involved.

In the absence of an amicable solution, under the terms of the preceding paragraph, and in the event of breach of these Terms & Conditions, both PARTIES establish the Court of Lisbon as the competent court, expressly waiving any other.
