TFVCFashion Lda, legal entity 516212907, with headquarters at Rua António Gedeão, 81, Casa 17, is the legitimate owner of the official TFVCFASHION.COM website, the domain of which can be found at http://www.tfvcfashion.com

2. Purpose

These Terms & Conditions exclusively regulate the purchase and sale made in TFVCFashion's online store between the "End Consumer" as buyer and TFVCFashion as seller, and apply to all visitors to the website www.tfvcfashion.com, as well as to any commercial transaction carried out through this virtual online store.

Browsing the website, as well as purchasing any product at http://www.tfvcfashion.com, implies acceptance of these general terms of use and contract.

An "End Consumer" is considered to be any person who acts/buys for purely personal reasons, outside of their business or profession, therefore, without any intention of reselling the items they purchase in the TFVCFashion online store.

TFVCFashion reserves the right to change these terms of use and contract, without prior notice, as well as to modify at any time the information and commercial offer presented on products, prices, promotions, commercial conditions and services, any changes always being published on the website www.tfvcfashion.com. Any new rules and/or changes to the Terms & Conditions will become binding on all "users" as soon as they are made available on the website www.tfvcfashion.com.

 

3. Placing an order online

To place an order at www.tfvcfashion.com, the "End Consumer" must follow the instructions provided. After choosing the item(s), click on "Add to Cart".

Upon completing the purchase, the "End Consumer" will receive an email confirmation of receipt of their order and its details. We suggest that you print or download this copy for future reference. If the data is not correct, you may immediately request its alteration, or even the cancellation of the purchase made.

The purchase will be completed when the confirmation appears on the screen.

The "End Consumer" can consult the data of their purchase(s) in their account in our online store, if they choose to register as a TFVCFashion Customer. This data is confidentially stored in our store, in accordance with our Privacy Policy.

In case of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, TFVCFashion reserves the right not to accept your order, or to cancel it totally or partially, even after automatic confirmation.

 

4. Shipping / order cancellation

TFVCFashion only processes an order placed by a customer after confirmation of the respective payment, so the Seller cannot guarantee the availability of the items until the start of said processing.

The item(s) will be shipped within three (2) business days.

Naturally, the estimated shipping time may vary depending on the destination of your order. TFVCFashion will not be responsible for any non-compliance, or delay in compliance, of any shipping obligation caused by a force majeure event, that is, an event, act or omission beyond its reasonable control.

TFVCFashion only ships orders on business days. Therefore, weekends and holidays are not counted when estimating the delivery time of orders. Any delay found in the shipment of items, compared to the estimated dates presented, does not give the right to compensation.

A delivery is considered made or a product is considered delivered with the signing of the delivery receipt at the agreed address.

You can request changes or cancel your order by email (info@tfvcfashion.com), at any time, until payment is made.

If you wish to make a purchase and the country/place where you want to send it is not on our shipping list, please send us an email to "info@tfvcfashion.com" or contact us via chat and tell us the item(s) you want and we will return the information on the associated shipping costs.

 

5. Product availability and order refusal

TFVCFashion may not validate an order that does not have sufficient guarantee of good collection, when the order is incomplete or incorrect, or when the ordered products are no longer available. In any of the cases mentioned, TFVCFashion will inform the "End Consumer" via email that the sales contract has not been made and that TFVCFashion has not proceeded with the sale, specifying the reasons for this.

If the products ordered at www.tfvcfashion.com are no longer available at the time of your last access to the website, despite having received order confirmation, or when TFVCFashion receives your request, the "Seller" will immediately inform the "End Consumer" about their unavailability, never exceeding 30 days after receiving the request.

If an order has been placed, and respective payment, for products that have since become unavailable, TFVCFashion will proceed with the refund of the money paid for the unavailable items.

In case of out of stock order, you can make a reservation to info@tfvcfashion.com. The user will be informed, within a maximum of 10 working days, of the replenishment of stock.

TFVCFashion reserves the right to refuse any order, regardless of the reason and is exempt from liability for any damages or costs, as well as reserving the right to cancel any purchase even if it has already been accepted or confirmed by TFVCFashion, namely in the following situations:

The information on the invoice is incorrect or unverifiable;
The order is flagged by the website's Security Systems as an incorrect, irregular order, or an order susceptible to fraud;
When payment for the order has not been received within 48 hours following the acceptance of your order;
When it is not possible to deliver the order to the address provided by the "End Consumer";
If it considers that the "End Consumer" did not have the capacity to carry out that act.
If there has been an error in the presentation of the price of the product(s);
If it is presumed that the order comes from a reseller.
 

6. Payment Conditions and Prices

Orders for item(s) must be paid by bank transfer, ATM, VISA or MBWAY.

The prices displayed on this site include VAT at the current rate and are valid for the time of purchase. In case of exchange of the product for another, the value of the definitive product applies. Prices and specifications are subject to change without prior notice.

The prices of the products displayed on the website www.tfvcfashion.com include Value Added Tax (VAT). 

The total price specified in the final transaction menu includes taxes and shipping costs.

All prices are listed in Euros and any change in the country of delivery of the order may affect prices, due to transport costs.

After your order, you will receive an invoice/receipt by mail, along with the ordered item(s), at the address indicated during the purchase process.

 

7. Security of the TFVCFashion online store and all transactions

TFVCFashion online store uses the latest and most robust security technologies available for encryption platforms. All payment information you provide will be encrypted, from the initial moment of your transaction, until the moment the order is processed, and will not be stored on any public server.

Although we use very advanced encryption software, any payment transmitted over the Internet, or via email, carries some risks, especially when the "End Consumer" does not take due precautions and does not assume due responsibility.

TFVCFashion cannot be held responsible for any damage suffered resulting from the use of electronic means of communication, namely damages resulting from failures or delays in the delivery of electronic communications, interceptions or manipulations of electronic communications by third parties or by computer programs used for communications or transmission of viruses.

 

8. Reservation of Ownership of marketed products / Exchange of Articles

TFVCFashion retains ownership of the company's products until full payment for all such products has been received.

Items purchased online may be exchanged/returned at the TFVCFashion store, within 14 consecutive days after receipt of the item at the customer's address, provided that:

The item is in the same original conditions or characteristics as it was sent to the customer;
they do not have the corresponding label or security seal, or when the labels have been altered from their original state or damaged.
The item shows no signs of having been washed and/or used;
If there is an error in the price quotation;
If it is not possible to deliver to the indicated address.
 

9. Quality and Warranty

The products offered for sale at www.tfvcfashion.com may not exactly correspond to the actual item in terms of the image displayed and colors, especially due to the internet browser and monitor used.

The "End Consumer" has the right to return delivered items that present defects or other non-conformities regarding what was ordered. The return can be made within fifteen (15) days after receipt of the order at the customer's address.

In the case of a justified return, the price and shipping costs will be reimbursed.

10. Liability

TFVCFashion will only be liable for damages suffered by the "End Consumer" if such damages result from breaches attributable to TFVCFashion's contractual obligations towards the "End Consumer", or if liability results from applicable legal rights.

If the "End Consumer" has suffered damages related to the website's activity, TFVCFashion's liability will be limited to: damages to TFVCFashion products, reasonable and verifiable costs incurred by the "End Consumer" due to TFVCFashion's breach of these Terms & Conditions.

TFVCFashion cannot be held responsible for damages suffered by third parties resulting from the use of any of our products. TFVCFashion cannot be held responsible for damages suffered by the "End Consumer" as a consequence of improper use of our products.

TFVCFashion is not responsible for damages resulting from incorrect information on the website.

All products marketed by TFVCFashion comply with Portuguese and European legislation.

TFVCFashion disclaims all liability in case of violation of the legislation of the country where the order is delivered. It is the Customer's responsibility to check with local authorities the conditions for importing or using the products they intend to order.

 

11. Intellectual and Industrial Property

All texts, comments, works, illustrations, works and images reproduced or represented on the website www.tfvcfashion.com are strictly reserved under copyright law as well as intellectual property rights, worldwide.

In accordance with this and under the Intellectual Property Code, the use of information for private purposes is only authorized, subject to contrary provisions including more restrictive provisions contained in the said code.

Any reproduction or total or partial representation of the website www.tfvcfashion.com, of all or part of the elements included therein, is strictly prohibited.

The corporate names, brands and distinctive signs reproduced on the website www.tfvcfashion.com are protected under the legal provisions applicable to industrial property. The reproduction or representation of all or part of any distinctive signs is strictly prohibited and must be subject to prior written authorization from the owner of the TFVCFashion brand.

 

12. Applicable Law

These Terms & Conditions and all emerging disputes related to these general conditions, including their validity, the use of the website tfvcfashion.com or any purchase therein, must be governed by Portuguese Law.

In case of dispute regarding the interpretation or execution of these General Terms and Conditions of Sale, TFVCFashion and the "End Consumer" undertake to strive to obtain an amicable solution, which is fair and appropriate, within a maximum period of 60 (sixty) days from the reception of the communication addressed for this purpose by any of the parties involved.

In the absence of an amicable solution, in accordance with the provisions of the previous paragraph, and in case of non-compliance with these Terms & Conditions, both PARTIES establish the Court of Lisbon as the competent forum, expressly waiving any other.
